National Commission on Regulation of Electric Power Industry

About Us



The National Commission for Regulation of the Electric Power Sector of Ukraine (NCRE) was established by the Presidential Decree No. 738, as of December 8, 1994, as an independent, non-departmental, standing government regulatory body.

Pursuant to the Law of Ukraine “On Electric Power Sector,” the NCRE is deemed a body of government regulation in the electric power sector.


In accordance with the Presidential Decree No. 853/97, as of August 19, 1997, “On Efforts Regarding Implementation of the Government Policy in the Natural Monopolies Area,” the National Commission for Regulation of the Electric Power Sector of Ukraine is assigned with the function to regulate activities of business associations in areas of oil and gas production and sales, natural gas transmission and distribution, pipeline transportation of oil, oil products, and other liquids.


Also, pursuant to the Presidential Decree No. 1573, as of December 15, 1999, the National Commission for Electric Power Sector Regulation of Ukraine is deemed a central regulatory body enjoying a special status.

In 1998, for the purpose to implement the government policy in the natural monopolies area and ensure the efficient regulation in the electric power and oil sector, the amended version of the Regulation On the National Commission for Regulation of the Electric Power Sector of Ukraine was approved by the Presidential Decree No. 335/98, as of April 21, 1998.

Main objectives of the Commission are as follows:

  • Engagement in formation and ensuring of implementation of a single government policy as to development and operation of the wholesale market of electric power, as well as oil, gas, and oil products markets;
  • Government regulation of activities carried out by natural monopoly entities in electric power and oil and gas sectors;
  • Facilitation of competition in areas of electric power production, electric power and gas supply, gas and oil production, storage and sales of gas, oil, and oil products;
  • Ensuring of implementation of a price and tariff policy in the electric power, oil and gas sectors;
  • Development and approval of rules regarding electric power and gas utilisation;
  • Protection of rights of consumers of electric power, thermal energy, gas, oil, and oil products;
  • Issuance of licenses to subjects of the entrepreneurial activity to produce, deliver, and supply electric power, enforcing compliance of the licensed entities with relevant requirements applicable to the activities subject to licensing;
  • Other tasks specified in legal and regulatory documents.

In pursuance of the tasks assigned to it, the Commission:

  • Develops and approves regulatory documents on issues included within its competence and subject to mandatory observance;
  • Approves Regulations on and Rules for carrying out activities subject to licensing and enforce compliance with them;
  • Enforce compliance of liquidation, reorganisation (merger, take over), membership in unions and associations, as well as acquisition or alienation of more than 25% of equity (shares or stakes) of assets of subjects of the entrepreneurial activity with relevant requirements and rules regulating activities subject to licensing;
  • Takes part in establishment of rules regarding operation of the wholesale market of electric power, gas, oil, and oil products, and in enforcement of compliance with them;
  • Within its competence, pursues the government pricing policy as to electric power, gas, oil, and oil products, respective transportation tariffs, supply, delivery, as well as pipeline transportation of other liquids;
  • Applies material sanctions to business associations and administrative sanctions to officials of enterprises, companies, institutions, and organisations as provided in legislation of Ukraine;
  • Enjoys other powers specified in legal and regulatory documents.

As of December 31, 1999, the Commission was composed of its Chairman and four Commissioners. Chairman and Commissioners enjoy equal powers to decide issues included in their competence. Their functions are specified in the Regulation On the National Commission for Regulation of the Electric Power Sector of Ukraine, approved by the Presidential Decree No. 213/95, as of March 14, 1995.

Functioning of the Commission is ensured by the Central Office. It is composed of Secretariat, functional departments, units, and 25 regional offices (in Autonomous Republic of Crimea, and regions of Ukraine).

The Commission prepares materials, holds meetings, and adopts decision in conformity with the Procedure for Consideration of Issues on NCRE Meetings.

Activities of the Commission are reflected in mass media, television, and radio on a regular basis.
